U.S. – EU and U.S. – Swiss Safe Harbor Participation for Client Engagement Data

Protiviti provides a broad array of consulting services to our clients worldwide.  In connection with providing such services, Protiviti accesses or receives in the United States certain personally identifiable information about individual contacts of Protiviti’s clients as well as clients' customers in the EU and Switzerland (“European Client Engagement Data”).  Protiviti  recognizes that the European Union (“EU”) has an “ominbus” data protection regime established pursuant to the European Data Protection Directive (95/46/EC) (the “Directive”) and that Switzerland has a comprehensive data protection law (together, “Data Privacy Laws”).  Among other things, the Data Privacy Laws generally require “adequate protection” for the transfer of personally identifiable information about individuals located in the EU and Switzerland to Protiviti’s operations in the United States.    Protiviti accordingly adheres to the requirements of the U.S.-EU and U.S.-Swiss Safe Harbor Privacy Principles published by the U.S. Department of Commerce ("Safe Harbor") with respect to European Client Engagement Data.  Protiviti acts as a data processor on behalf of our EU and Swiss clients with respect to European Client Engagement Data, and our clients act as the data controller for any such data.  Protiviti accordingly only carries out the instructions of such clients with regard to the collection, processing, and protection of European Client Engagement Data.  Individuals with questions about European Client Engagement Data may first wish to contact the relevant Protiviti client with whom the European Client Engagement Data was initially shared, as this may be the most efficient means of addressing such access requests.  If necessary, such individuals may also contact the Protiviti Safe Harbor Privacy Contact identified below with questions and/or to review European Client Engagement Data that Protiviti holds about them.  Any such individuals who cannot resolve their issue directly with the client or Protiviti can contact the local data protection authority for further information and assistance.  Additional information about Safe Harbor is also on the US Department of Commerce website at http://www.export.gov/safeharbor/.
